OX Factory Terms of Service

Article 1 (Purpose)

These Terms set out the conditions and procedures for using "OX Factory" (the "Service"), which VIBEMENT CO., LTD. (the "Company", "we", "us") operates. They also set out the rights and duties of the Company and its members.

Article 2 (Definitions)

  1. The "Service" is a service where you answer O/X questions and AI makes pictures and a plan for you.
  2. A "Member" is a person who has agreed to these Terms and signed in with Kakao or Google.
  3. "Coins" are the unit of use inside the Service. They are spent on questions, plans, designs, "Try building it" and "Make it mine".
  4. A "Project" is the questions and answers, pictures and plan that a member makes in the Service.

Article 3 (Posting and Changes)

We post these Terms on the Service screen. When we change them, we announce what changes and the effective date at least 7 days before it takes effect (at least 30 days before if the change is unfavorable to members).

Article 4 (Joining)

  1. A person aged 19 or older becomes a member by agreeing to these Terms and signing in with Kakao or Google.
  2. If someone joins with another person's account or lies about their age, we may restrict their use.

Article 5 (Trial)

You can try up to 3 questions without signing in (5 if you first arrive through a link another member shared). Trial records are deleted 30 days after last use.

Article 6 (Coins)

  1. We give 100 free coins to each new member. This happens once per account.
  2. When a signed-in member visits the Service for the first time on a given day (Korea time), we record their attendance, and if they have 100 coins or fewer at that moment, we give 10 free coins (attendance reward).
  3. When a person who joined for the first time through a member's invite link receives their first plan (10 or more questions), we give 50 free coins to the inviting member (up to 30 invited people per member per month). An invited person receives the same sign-up coins as any other member. We may take back coins received by creating multiple accounts.
  4. Where coins are used and how many (for example, 1 coin per question and 10 coins to get a plan) are shown on the Pricing page. A question you change to a different topic does not use coins.
  5. Free coins cannot be exchanged for cash, refunded or transferred.
  6. Coin prices and uses may change under the Service's policy. We will tell you before they change.
  7. Paid coins can be bought on the "Top up coins" screen in the Service. Prices and packs are shown on the Pricing page.
  8. The seller of paid coins is the Company. Payments and payment cancellations are processed by KG Inicis, an electronic payment gateway, and we use the service of PortOne (Korea PortOne Co., Ltd.) to connect payments. When you pay in USD with a card issued outside Korea, Dodo Payments Inc. and its affiliates act as the merchant-of-record reseller: the checkout names dodopayments.com as the Merchant of Record, they sell the coins to you and handle payment, tax and refunds, and their buyer terms (https://dodopayments.com/buyer-terms) also apply to that purchase.
  9. Free coins are used first. Paid coins are used oldest purchase first.
  10. Paid coins (including bonus coins) can be used for 1 year from the purchase date. Paid coins that can no longer be used after 1 year can still be refunded under item 12 within 5 years of the purchase date. Paid coins can be used only in the account of the member who bought them and only in this Service. They cannot be transferred to another person or exchanged for cash. Coins are a credit for using this Service, not a virtual asset or cryptocurrency.
  11. If you have not used any of them within 14 days of purchase, we refund the full amount. If you have used some, we refund the remaining paid coins with no deduction (remaining paid coins × the price per coin of that pack).
  12. You can also get a refund for remaining paid coins after 14 days. In this case, we refund the remaining paid coins × the price per coin of that pack, minus 10%.
  13. You can request a refund at [email protected]. Within 3 business days of receiving the request, we cancel or refund the payment to the original payment method through the payment gateway. Depending on your card company, the money may take a few more days to arrive. For mobile phone billing, once the month of payment has passed the carrier charge can no longer be cancelled, so after confirming your identity we refund to a bank account in the payer's name. When we refund, the paid coins for the refunded amount are removed.
  14. If an error on our side means a question, picture or plan was not delivered but coins were deducted, we return the same kind of coins. If we stop running the Service, we refund remaining paid coins with no deduction.
  15. If fraudulent payment is confirmed, such as secretly using another person's payment method, or if coins bought with a payment were used after that payment was cancelled (chargeback), we may take back those coins and restrict use.
  16. When another user taps O on "Would you use this?" for a member's project, we give the member who made it 2 free coins (up to 100 coins per member per day). We do not give coins for fraudulent votes, such as votes that appear to be your own or votes concentrated from the same access point, and we may take back coins received that way.
  17. When a member sends feedback of 10 or more characters through "Send feedback", we give 5 free coins (once a day, up to 3 times a month). We do not give coins for repeated or meaningless text, and coins received improperly may be taken back.

Article 6-2 ("Try building it" and "Make it mine", Paid with Coins)

  1. A project whose design is finished can get a clickable preview through "Try building it", and after seeing it, the member can have a real, working service built through "Make it mine". Prices are paid in coins and shown on the Pricing page. One coin counts as ₩100.
  2. "Try building it" is a preview that shows the front part of the service, built in the design you chose, with sample data, a test login and a test payment (no money is charged). It is open at a preview address for 30 days and then deleted (your plan, pictures and design concepts stay in "My projects"). Previews are not edited. A member can try one build at a time, and a project is not previewed again while its preview is open (after it is deleted, you can try it again).
  3. When "Try building it" is finished, the "Make it mine" tier and price for that service are shown next to the preview, and you can choose "Make it mine" at that price while the preview is open (30 days). The coins you paid for "Try building it" are then taken off the price. "Make it mine" includes what is listed next to the preview (your own data · real login · real payment · admin screen · your own address · 2 rounds of edits · first month of running).
  4. "Try building it" has limits on how many previews are built at once and how many start each day, so if no slot is free you wait in order of request. While waiting you may cancel at any time, and no coins are taken. Coins for "Try building it" are paid when building starts; coins for "Make it mine" are paid when you press it.
  5. When you pay with coins, we check that the coins were earned in line with these Terms (friend invites, votes and so on). If the check is not passed, or if we cannot start for reasons on our side, we return the coins in full as the same kind (free or paid). Returned paid coins keep their original purchase date and validity.
  6. For "Try building it", once we deliver the preview, the coins are not returned. If the Company cannot make the preview, we return them.
  7. For "Make it mine", before the work starts (before it passes the check and we begin adding your own data, real login and payment), you may cancel at any time and we return your coins as in item 5. After it starts, it is a service made individually to your order, so cancelling does not return coins. The first month of running is part of the same package and is not refunded separately. However, if the Company fails to deliver the promised result, we return the coins you paid.
  8. Services made through "Make it mine" show a "Made with OX Factory" badge, which stays while the service runs.
  9. Running the built service while it is online follows Article 6-3. The first month's running fee is included in the "Make it mine" price.
  10. Rights in the project and in what is built follow Articles 9 and 9-2.

Article 6-3 (Running the Built Service)

  1. While a service built through "Make it mine" is online, the Company handles its servers, backups, security, outage monitoring and repairs. Bugs where the built service behaves differently from the agreed specification are fixed free of charge while you pay the running fee.
  2. The running fee is paid in coins every month. The base fee for each tier and the usage-based fee (text messages, KakaoTalk notifications, AI features, storage and so on) are shown on the Pricing page, and we tell you the expected running fee for your service before the build starts.
  3. The first month's running fee is included in the build fee. From the next month, that month's fee is deducted from your coins on the 1st (Korea time). We do not charge your card or any other method automatically.
  4. If usage in a month looks set to exceed twice the expected amount, we let you know. When it reaches the cap you set (three times the expected amount if you set none), only that feature (for example, sending text messages) pauses for the rest of the month. The service stays online.
  5. Once your coins fall below next month's running fee, we notify you several times in the Service until the deduction day (the 1st), and also at the contact you gave in your request, if any.
  6. If you do not have enough coins for the running fee on the 1st, no fee is deducted and the built service switches to a "Taking a short break" screen from that day. Its data is kept. If the break goes on for more than 90 days, we delete the built service and its data, and we notify you 30 days and 7 days before deleting.
  7. If you pay the running fee during the break, we reopen the service right away. We do not charge for the break.
  8. You can download the built service's code, data and guide (export) free of charge at any time, including before deletion.
  9. You can stop running the service at any time. From the next month no running fee is deducted and we proceed as in item 6, or delete it right away if you ask. The running fee already paid for the current month is not returned.
  10. If the built service could not be used on some days for reasons on the Company's side, we return that month's running fee for those days in coins.
  11. For small edits (text, photos, prices) and new features, we tell you the price first and proceed after you confirm. The "Customers ↔ operator" tier includes one small edit per month in its running fee.

Article 6-4 (Personal Information in the Built Service)

  1. If the built service processes personal information of its users (your customers), you are the controller of that information and the Company processes it on your behalf as a processor. This Article is the outsourcing document under Article 26 of the Personal Information Protection Act of Korea.
  2. The Company uses that personal information only to run the built service (storage, backup, security, handling outages and edits you request), and does not use it for any other purpose or give it to anyone else.
  3. The Company keeps access rights to a minimum and takes safety measures such as encrypted communication and keeping access logs.
  4. To run the service, the Company may sub-entrust the processing to providers of servers, networks and AI work tools. These are listed in the built service's privacy policy, and we will tell you before we change them.
  5. You may ask about or request a check of how the Company processes the information, and the Company will answer in good faith.
  6. When the built service is deleted, that personal information is deleted with it. If you ask, we return it to you by export before deletion.
  7. If a leak or other damage occurs through the Company's fault, the Company is responsible. If we learn of a leak, we notify you without delay.
  8. The Company drafts the built service's privacy policy and terms, and posts them on that service after you confirm them.

Article 7 (Providing and Changing the Service)

  1. The Service is currently in beta. Features and screens may change.
  2. The Service may stop for a while because of maintenance, outages or issues with external AI services.

Article 8 (AI Output)

  1. Questions, pictures and plans are reference material made by AI. We do not guarantee that they are accurate or complete.
  2. Before you actually build, make or invest in anything, please have an expert check it.
  3. You are responsible for what you enter (the one word, answers and descriptions) and for how you use the output made from it. Before you publish the output or actually make it, please check that it does not infringe anyone else's rights (trademark, copyright, design rights, portrait rights).
  4. We may refuse to make, hide or delete inputs and output that violate the law, these Terms or the AI provider's usage policies.
  5. If you think output infringes your rights, please tell us at [email protected]. After checking, we hide or delete that output without delay and tell you the result.

Article 9 (Rights in Projects)

  1. The rights to what a member enters and to the Projects made from it belong to the member. We store and process them only as far as needed to provide the Service.
  2. We may show the title, one-line summary and pictures of a Project that has reached a plan, together with its O/X record (only the O and X marks, without the questions), in the "Gallery" in the Service and on that Project's share page. The Gallery and share pages are web addresses that anyone can open without logging in, so their title, one-line summary and pictures may also appear in search results of search engines such as Naver and Google. In every case, the creator's name and account are not shown, and the questions and answers, the rest of the plan text beyond the one-line summary, previews and any app built are not shown.
  3. A member can remove a Project from the Gallery at any time by turning off "Show in gallery" on the Project screen. Once turned off, it is hidden right away, and we take steps so that it also drops out of search results. Copies or previews already stored by a search engine may remain for a few days to a few weeks until the search engine checks again. If you need it removed sooner, tell us at [email protected] and we will ask the search engine to remove it. Deleting the Project or the account also removes it.
  4. If you think a picture shown in the Gallery infringes your rights, please tell us under Article 8, item 5.
  5. A "Daily OX" result is shown on a share link and in that day's collection for the same topic only when the member presses [Share]. Even then, the maker's name, account and the questions are not shown — only the topic, the picture and the O/X record. Shared results and that day's collection can be opened without logging in, so they may also appear in search engine results. To take down a shared result, delete the Project or tell us at [email protected] (copies left at search engines are handled as in item 3).

Article 9-2 (Rights in What Is Built)

  1. The preview from "Try building it" (code and design) belongs to the Company. The member may view the preview and show its address to others. Anyone with the address can see it; the Company keeps it out of search engines and deletes it when its open period ends. Previews cannot be downloaded.
  2. From a preview, the Company reuses only common parts separated from the member's plan, and does not build and sell the same service to anyone else from that member's plan.
  3. For a service made through "Make it mine", the code and design specific to that service are handed over to the member to the extent any rights arise in them, and the Company makes no claim to them. Frameworks and parts shared across services are licensed to the member for use in that service without time limit, and the Company keeps using them. Open-source parts follow their own licences.
  4. Before showing a preview or a built service to others, please check that it does not infringe anyone else's rights, as in Article 8, item 3.

Article 10 (Prohibited Acts)

Members must not do any of the following.

  1. Enter content that breaks the law or infringes the rights, reputation or personal information of others
  2. Use the Service to make content that goes against public order, such as obscene, violent or hateful content
  3. Use automated tools for bulk use, or interfere with the operation of the Service
  4. Use another person's account, or create multiple accounts to get free coins
  5. Use the Service to make the face or appearance of a real person (including celebrities), or to make something look like them, without that person's consent; or use the Service to make sexual output

The Acceptable Use Policy gives examples of what these rules cover.

Article 11 (Restrictions on Use)

If a member breaks Article 10, we may give a warning, suspend use or delete the account.

Article 12 (Leaving the Service)

Members can delete their account at any time in "My plans". Deleting removes Projects and remaining coins right away, and this cannot be undone. If you have remaining paid coins, you can request a refund under Article 6, item 12 before deleting. We remind you of this once more on the screen.

Article 13 (Limitation of Liability)

We are not liable for damage caused by natural disasters, outages of external services (Kakao, Google, AI services) or the member's own fault. This does not apply to damage caused by our intent or gross negligence.

Article 14 (Dispute Resolution)

These Terms are governed by the laws of the Republic of Korea. Disputes are resolved in the court with jurisdiction under the Civil Procedure Act of Korea.
